The present General Terms and Conditions of Sale govern the sales of personalized COVER EDITION items by the company DADIER, a simplified joint stock company with a capital of 1,800,000 euros, located in Paris 75002 - 113 boulevard de Sébastopol 75002 PARIS registered with the Paris Trade and Companies Register under the number 482 113 982.

The personalized article(s) COVER EDITION are exclusively sold by the company DADIER.

Before validating your order on the site, you will be informed of the exact identity of the seller, by clicking on the link to access the General Terms and Conditions of Sale located above the "Payment" button. The identity of the seller will also be mentioned on the invoice available from your customer account.

Attention the articles sold on the site being personalized, you do not have the right of retraction. The fact of placing an order implies full and complete acceptance of these General Terms and Conditions of Sale, which are accessible at any time on the site and in particular at the time of registration of the order. We invite you to print and keep a copy of these General Terms and Conditions of Sale for future reference. Unless proven otherwise, the data recorded by us constitute proof of the transactions and their date.

The General Terms and Conditions of Sale constitute the only agreement between the parties and prevail over any other document. They may be modified at any time. The new General Terms and Conditions of Sale will be applicable to any order after they are made available on the site.

Orders placed on the site are reserved for individuals and companies "final buyers" other than for resale. The resale of articles COVER EDITION is strictly forbidden to any buyer who would trade in it on a professional basis.

For Great Britain, individuals must be of legal contracting age (18 years or older).

ARTICLE 1 - THE ITEMS OFFERED FOR SALE ON OUR WEBSITE ARE ONLY CUSTOMIZABLE.

 

COVER EDITION personalized articles, created and manufactured according to your specifications within the exclusive limit of the choices proposed at the time of the order. The offers of the articles are within the limits of available stocks. The indications on the availability of the articles are provided at the time of placing the order.

 

ARTICLE 2 - THE UNIT PRICES OF THE ARTICLES AND THE TOTAL AMOUNT OF THE ORDER

The prices of the articles are inclusive of all taxes (VAT rate in force on the day of registration of your order), excluding transport costs and possible customs duties.

They are indicated in Euros.

They can be modified at any time, being understood that the articles are invoiced on the basis in force at the time the order is recorded.

The total amount of the order you are planning to place is visible at each stage of the validation of your order.

 

ARTICLE 3 - THE ORDER

3.1 The order taking is subject to the respect of a procedure whose main steps are as follows:

  • Selection of article(s) :
  • Selection of the model, then personalization of the article in several steps ;
  • Choice of the gift option and addition of a personal message ;
  • Choice of delivery method and billing address ;
  • Bank information ;
  • Acceptance of the General Terms and Conditions of Sale ;
  • Validation of the order by means of the "PAYMENT" button.

The items in your basket remain visible at each stage of the validation of your order.

Once your order has been placed, you will receive a printable order confirmation email message in lieu of a purchase order, containing :

  • the present General Terms and Conditions of Sale,
  • the contact details of our Online Sales Customer Service,
  • information on the right of withdrawal,

You will receive an email confirmation of shipment when your order is shipped.

The invoice will be available online from your customer account.

3.2 Important

You may cancel your order within 24 hours of placing it. To do so, please contact us by e-mail at [email protected].

We reserve the right not to honour an abnormal order or an order made in bad faith, as well as for any other legitimate reason.

 

ARTICLE 4 - PAYMENT

The payment of your purchases is made exclusively, at the time of placing your order, by credit card (Visa, Eurocard/Mastercard).

Your credit card will be debited: 24 hours after placing your order, in the currency of your order;

You make your purchases in complete security, the confidentiality of the banking information that you transmit via the site to an approved banking establishment is ensured in a secure environment (SSL protocol).

Payment card numbers are not stored on our site but on the secure site of a banking establishment.

Within the framework of payments made by electronic means, and in order to combat fraudulent use of means of payment on the Internet, we check the reliability of the information entered by you at the time of registration of your order.

Thus, we proceed to the verification of concordance between the credit card address and the billing address.

We also reserve the right to ask for additional information or documents (photocopy of identity card, proof of address...) in order to validate your purchase and ship your package. These requests will be made by e-mail or by phone:

  • For an order that has a different delivery address from the billing address ;
  • For new customers;
  • For an order exceeding two hundred (200) euros.

We remain the owners of the items sold until full payment of the price, including VAT, transport costs and possible customs duties.

 

ARTICLE 5 - DELIVERY

 - Home delivery. The hours and days of delivery are determined by the carrier depending on the country of destination (Chronopost, UPS...).

- Delivery in relay point in all France. 

5.1. DELIVERY - DESTINATION

5.1.1- All Products are delivered to the postal delivery address provided by the Customer when placing the order.

5.1.2- All Customers are invited to regularly consult their "Order Tracking" and to contact Customer Service by clicking on "Contact".

 

5.2. DELIVERY - RATES

The shipping costs are indicated to you during the ordering process before validation of the payment. Possible customs duties may apply when ordering to countries outside the European Union. Please note: these customs duties will be communicated to you by the carrier at the time of delivery and will have to be paid directly in order to receive your package.

 

 

5.3. DELIVERY - DEADLINES

A delivery time appears during the ordering process before validation. Unless special deadlines are mentioned during holiday periods, you will be delivered within a maximum of 3 weeks.

You did not receive your order within the indicated period:

  • You have received the shipping confirmation email but you have not received your order within the indicated time frame: please contact the carrier with the tracking number that was given to you.

For deliveries made in Belgium, please note that any reservations or complaints concerning delays must be notified to the carrier by extrajudicial act or registered letter within a period not exceeding seven days, not including that of receipt.

COVER EDITION cannot be held responsible for delays in delivery that are attributable either to the Customer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.

 

5.4. DELIVERY - RECEPTION

Upon receipt of your order, systematically check the condition of your package, the good condition of the item ordered, as well as its compliance with the order.

If you notice that your parcel or your article has been damaged, we invite you to specify it on the delivery note of the carrier, and to contact us immediately by email at the email address indicated in the table on page 2 hereof.

We also invite you to keep the shipping packaging.

In your message, don't forget to mention the damage observed (wet package, punctured, open, etc.). In all cases, you have a period of three days, not including public holidays, from receipt of your package to notify the carrier, by extrajudicial act or registered letter, of any reservations you may have. This period is extended to two months for deliveries in the Netherlands and to two days for deliveries in Belgium.

Specific recommendations concerning the carrier Chronopost: The recipient's digital signature, as well as its reproduction, is proof of the delivery of the parcels and the parties acknowledge that this signature has a legal value identical to that of a traditional signature on paper. 

At the time of delivery, any damage or spoliation must be the subject of written, precise, complete, dated and signed reservations by the recipient on the delivery slip.

 

ARTICLE 6 - RETURN - RIGHT OF WITHDRAWAL

Given the unique and personalised nature of the personalised article, it cannot be taken back or exchanged.

As a result, you have no right to invoke any right of withdrawal. Therefore, we recommend that you devote the necessary time and attention to the creation of your article.

  

ARTICLE 7 - EXCHANGE

Given the unique and personalized nature of the personalized item, it cannot be exchanged.

 

ARTICLE 8 - GUARANTEES - AFTER-SALES SERVICE - LIABILITY

8.1. LEGAL GUARANTEES

The proposed items comply with the regulations in force. They benefit from the know-how and quality of COVER EDITION as well as legal guarantees.

8.2. AFTER-SALES SERVICE

The COVER EDITION After Sales Service is responsible for carrying out repairs within the framework of the implementation of the Legal Warranties.

Subject to the legal provisions in force, your article will be transmitted to our workshops which will take the appropriate decision:

In the event of a manufacturing defect found and validated by our workshops, we will repair your item free of charge or replace it with a new item of equivalent value.

 

8.3. RESPONSIBILITY

We are not responsible for the possible difference in "screen/reality" colour, for the terms of the personal message accompanying your gift and their possible consequences, for the choices of personalisation of the personalised item that would not be suitable, even if it is a gift.

Furthermore, we shall not be considered responsible or defaulting for any delay or non-performance due to the occurrence of a force majeure event.

Finally, we draw your attention to the fact that we cannot be held responsible for an order placed by a minor, whether or not the parents have authorized this order.

 

ARTICLE 9 - PRESERVATION OF DOCUMENTS

For any order over 220 euros including tax, we undertake, for a period of ten consecutive years, to keep the documents relating to the transaction. We guarantee you access to them at any time, upon request.

 

ARTICLE 10 - PERSONAL DATA

10.1- The information and data concerning the Customers are necessary for the management of the orders as well as for the establishment and improvement of the commercial relations with the Customers. They may be transmitted to persons who contribute to these relations such as those in charge of Customer Service, the Return Service, order preparation and Product transport. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations, and also to enable COVER EDITION to improve and personalise the services offered and the information communicated to Customers.

 

10.2- In accordance with the law n° 78-17 of January 6, 1978 relating to data processing, files and liberties, any Customer has a right of access and rectification to personal data concerning him/her. He/she simply needs to make a request to the Customer Service Department, indicating his/her surname, first name, e-mail address and Customer account number.

 

ARTICLE 11 - INTELLECTUAL PROPERTY

The intellectual property rights on the site and on all the elements that make it up (brands, models, copyrights, domain names...) are the subject of a property right or exclusive use for the benefit of COVER EDITION. Any total or partial reproduction of the site, without the express agreement of COVER EDITION, is forbidden, except for personal and private use, excluding any commercial purpose.

 

ARTICLE 12 - APPLICABLE LAW - DISPUTES

12.1 The present General Terms and Conditions of Sale, the order and all acts arising therefrom are governed by French law.

 

12.2 In the event of a dispute, we invite you to first contact us by e-mail at the following address [email protected] Failing amicable settlement of the dispute with our Online Sales Department, you may have recourse to a conventional mediation procedure or any other alternative dispute resolution method.

For orders delivered in France, you can contact the mediation service of the Fédération du E-commerce et de la Vente à Distance (FEVAD), to which we are a member:

  • By mail, by writing to the FEVAD e-commerce mediator (60 rue de la Boétie, 75008 Paris);
  • Online, by filling in the form available on the FEVAD e-commerce mediator's website (http://www.mediateurfevad.fr).

You can also resolve the dispute through the Online Dispute Resolution platform put online by the European Commission (http://ec.europa.eu/consumers/odr/).

In the event of a dispute and in the absence of an amicable settlement, the French Courts have sole jurisdiction.

 

12.3- When in the present conditions a time limit is expressed in days, that of the act, event, decision or notification which makes it run does not count. Any time limit expires on the last day at twenty-four hours. Any time limit which expires on a Saturday, Sunday or public holiday or non-working day shall be extended until the first working day thereafter.

 

12.4- Any reference on the Site or on any other medium whatsoever issued within the framework of the use of the Site, at a time of day, on days of the week, months of the year as well as on public holidays or legal holidays, is, unless expressly indicated otherwise, considered as a reference to the legal time in Paris, to the days, months and years of the Gregorian calendar and to the public holidays and legal holidays in force in metropolitan France.
